Our website http://panel.gfkmediaview.com (“Website”) is operated by GfK UK and its subsidiaries ("we/us/our"). We are incorporated and registered in England and Wales with company number 2512551, with registered office at 25 Canada Square, Canary Wharf, London, E14 5LQ, United Kingdom.
We are company partners with the MRS (the Market Research Society), we comply with the MRS code of conduct and our work is carried out in accordance with standards ISO 9001:2015 Quality Standards and ISO 20252:2012 market, opinion and social research. Additionally we are a corporate member of ESOMAR (European Society for Opinion and Marketing Research). ESOMAR is the world organisation for enabling better research into markets, consumers and societies and sets the professional standards for its members to comply with and also protects your privacy.
If you do not agree to the terms of this Contract, you must not use our Portal or participate in our Studies.
As part of the Studies, we also use our Portal to invite Panellists to complete the media usage survey which involves understanding their online behaviour including their use of television and media websites. If you are invited to participate in this Study, we will look at audience behaviour in aggregated form (not your personally identifiable data). The results of these Studies are provided to our clients in the television and media sectors and other related industries. We offer participation in the GfK MediaView Portal, provided: (i) you accept these Terms in full; (ii) you are sixteen (16) years of age or older; (iii) you are resident in the United Kingdom; and (iv) you have only registered with the GfK MediaView Portal once. Your registration and/or participation as a Panellist of the Services constitute your agreement to this Contract. Certain GfK MediaView Portal Member Rights and Obligations
In order to participate in the Services, you must enrol as a Panellist and remain a Panellist in good standing. From time to time, we may invite you to participate in a Study by one or more communication methods, including e-mail, fax, text and telephone; we may also contact you in person. By enrolling as a Panellist, you hereby consent to any such form of contact. Your contact information should be kept up-to-date to ensure you receive our invitations in a timely manner. Your profile and other information should be updated regularly as we use such information to determine your eligibility for participation in the Services. Of course, you are not obligated to participate in any Study, as participation is completely voluntary.
Portal Registration, Password and Account Security
When registering as a Panellist, you must complete the registration process, including providing profile and other information by registering an account on our Portal. Upon registration you will be assigned an account with a user name and password. You are responsible for maintaining the confidentiality of your account and log-in details, and are fully responsible for any activities that occur under your account. Accounts may not be shared and may only be used by one individual per account. If you know, suspect or become aware of any unauthorised access to your account by a third party, you should notify GfK immediately at email@example.com. If you know or suspect that anyone other than you knows your user name and/or password, you must promptly notify us at firstname.lastname@example.org.
From time to time we may ask you to update such account information and/or provide additional account information. Your eligibility to participate in certain Studies may depend on whether the account information you provide is current, accurate and/or complete. You represent and warrant that the account information you provide will be current, accurate and complete and that you will update such account information from time to time to ensure it remains current, accurate and complete. Provision of incomplete, inaccurate or out-of-date account information is grounds for immediate termination of your use of the Services. Termination means that you will no longer be a Panellist and eligible to participate in our Services. You may enrol only once. Multiple enrolments will be considered a breach of this Contract and, at our discretion, may be grounds for immediate termination of your MediaView Portal Membership.
We have the right to disable any user name or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of this Contract.
Removal from the Panel
You may be removed from the MediaView panel for any of the following reasons and where this is the case you will forfeit your rights to redeem any outstanding points.
‘Period of Inactivity:
• You will be removed from the Panel after 6 weeks of non-activity/not entering portal
• You will be removed from the Panel if you send Inappropriate, threatening or otherwise unacceptably worded email communications / posts to the portal or any other form of unacceptable behaviour towards the MediaView Helpdesk staff or any other GfK staff member.
‘Continual Nil viewing’
• You will be removed from the Panel if you continually log for a period of 6 weeks that you have not watched any TV or listened to any Radio.
‘Issues with quality of responses’
• You will be removed from the Panel where systematic issues are found with the quality of responses given.
‘More than one account’
• You will be removed from the Panel if during our systematic checks it is suspected that you have created more than one account.
Compensation and Incentives
To the extent permissible by law, we may agree with you as part of the commission of a Study to compensate you for your participation in a Study by way of incentives. The amount and nature of the incentives may vary depending on the Study, but in all instances will be disclosed to you prior to your agreement to participate in such Study.

Changes to these terms
We may revise these Terms at any time, without notice to you by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
Changes to our Portal
We may update our Portal from time to time, and change the content of the Portal or any Study at any time. However, please note that any of the content on our Portal may be out-of-date at any given time, and we are under no obligation to update it. We do not guarantee that our Portal or any Study, or any content therein, will be free from errors or omissions.
Accessing our Portal
We do not guarantee that our Portal, or any content on it, will always be available or be uninterrupted. Access to our Portal is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Portal without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our Portal.
Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our Portal, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our Website for your own personal use, but you must not modify the paper or digital copies of any materials you have printed off or downloaded in any way. You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the content in the Services for any purpose, other than for the purposes of your participation in the relevant Study.
If you print off, copy or download any part of the Services in breach of these Terms, your right to use the Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
No reliance on information
Although we make reasonable efforts to update the information on our Portal, we make no representations, warranties or guarantees, whether express or implied that the content on our Portal is accurate, complete or up-to-date.
Limitation of our Liability
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Services or any content on it, whether express or implied. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
use of, or inability to use the Services; or
use of or reliance on any content displayed as part of the Services.
Please note that we only provide our Portal for use in connection with your participation in the Studies. You agree not to use our Portal for any other purpose and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Portal or to your downloading of any content on it, or on any website linked to it.
We assume no responsibility for the content of websites linked on our Portal. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
We do not guarantee that our Portal will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our Portal. You should use your own virus protection software. You must not misuse our Portal by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Portal, the server on which our Portal is stored or any server, computer or database connected to our Portal. You must not attack our Portal via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you may be committing a criminal offence under local computer misuse laws. We will report any such breach to the relevant law enforcement authorities and co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Portal and participate in our Studies will cease immediately.
Linking to our Portal, Third Party links and resources in our Portal
You must not establish a link to our Portal in any website including your own. Where our Portal contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources.
These Terms, its subject matter and formation, are governed by the laws of England and Wales. You and we both agree that the place of performance and the location of the courts where any disputes will be resolved shall be the courts of England and Wales.
